Au-delà des émotions et des interprétations rapides, il est important de rappeler que la loi sur la sous-traitance en RDC a été adoptée avec un objectif précis : permettre aux entreprises congolaises éligibles d’accéder effectivement aux marchés générés par les grandes entreprises opérant sur notre territoire.

Cette loi ne vise pas à décourager l’investissement. Elle vise à structurer l’économie nationale. Elle vise à corriger des déséquilibres historiques. Elle vise à faire en sorte que l’exploitation de nos ressources naturelles produise un impact réel et mesurable sur l’emploi local, le transfert de compétences et l’émergence d’un tissu entrepreneurial congolais solide.

En exigeant l’annulation de contrats jugés non conformes aux dispositions légales en vigueur, l’ARSP ne crée pas une nouvelle règle. Elle rappelle simplement que le cadre juridique existant doit être respecté. C’est cela, la base d’un État de droit.

Un pays attractif n’est pas un pays sans régulation. C’est un pays où les règles sont claires, connues et appliquées de manière cohérente et équitable. La crédibilité institutionnelle repose précisément sur cette constance.

Il est également important de souligner que la décision prévoit une période de transition afin d’éviter tout arrêt ou dysfonctionnement des activités minières. Cela démontre que la régulation peut être ferme tout en restant responsable. L’objectif n’est pas de fragiliser la production, mais d’assurer la conformité et l’équilibre.

Le véritable enjeu ici est le contenu local. Garantir l’accès des entreprises congolaises enregistrées et éligibles aux marchés de sous-traitance, c’est renforcer l’économie nationale, consolider la paix sociale dans les zones d’exploitation et encourager une croissance plus inclusive.

Dans un contexte où les communautés locales attendent des retombées concrètes de l’exploitation minière, la régulation joue un rôle central pour maintenir la confiance et prévenir les tensions.

Si cette décision est mise en œuvre avec dialogue, transparence et rigueur, elle peut constituer un pas important vers une gouvernance économique plus structurée et plus équitable.

Le développement durable de notre secteur minier passe par un équilibre : attirer les investisseurs, mais aussi protéger et valoriser les capacités nationales.

C’est dans cet équilibre que se construit la souveraineté économique.

La Fédération des Entreprises du Congo (FEC) sollicite officiellement un étalement de l’application de ce nouveau tarif. Le patronat souligne que le passage brutal de 14 500 FC à 21 500 FC représente une charge financière insoutenable pour de nombreuses entreprises, risquant de fragiliser leur santé économique.

Un argument majeur avancé par la FEC concerne l’effet de cascade sur l’ensemble de la grille salariale lors de la restitution du 37e Conseil National du Travail tenue du 16 au 20 février.

« Suite à plusieurs entreprises qui ont adressé des courriers assez alarmants auprès du ministère du travail sur le fait que l’application de 21 500 posait un problème dans beaucoup de secteurs. Aujourd’hui malheureusement si nous appliquons les chiffres tels quels, nous allons dans une hécatombe. » a déclaré John MWENDA coordonnateur du CNT

Et d’ajouter :

« Donc nous avons conclu le CNT sur deux points de vue. Le point de vue des entreprises est d’appliquer le SMIG par palier pour les autres secteurs. Ça veut dire on applique 16 500 dès le mois de janvier 2026, 19 500 dès le mois de juillet 2026 et pour chuter à 21 500 tel que annoncé par le président de la république dès le mois de janvier 2027. »a-t-il insisté

Si le SMIG du manœuvre passe à 21 500 FC, le salaire d’un cadre de collaboration pourrait atteindre 2 500 USD, un niveau jugé supérieur à certains standards européens et déconnecté des réalités économiques

Malgré ce plaidoyer, la Première Ministre Judith Suminwa Tuluka a réaffirmé la fermeté du gouvernement. Elle insiste sur le respect du Décret n° 25/22 qui actait déjà cette hausse en deux paliers (mai 2025 puis janvier 2026), avec pour objectif de protéger le pouvoir d’achat des travailleurs face à l’inflation.

Les discussions se poursuivent au sein du Conseil National du Travail, où les partenaires sociaux (Gouvernement, Employeurs, Syndicats) tentent de trouver un consensus sur les modalités d’application, notamment sur la gestion de cette tension salariale et la situation spécifique du secteur agricole (SMAG).
