L’avis rendu public sur la Radiotélévision nationale congolaise concerne des arrêtés promulgué le 1er juillet 2025, fixant les modalités d’exercice des prestations de services et de la sous-traitance dans le secteur des hydrocarbures. Le second, en date du 6 novembre 2025, autorise la société Kamoa Copper SA à produire, commercialiser et stocker des acides.

À travers cet examen, le Conseil d’État a été amené à se pencher sur des questions relatives aux compétences réglementaires et à l’opportunité d’une régulation autonome par les ministres sectoriels.

Dans son avis, le Conseil précise que la régulation de la sous-traitance est une matière transversale qui englobe tous les secteurs d’activité. Cependant, souligne la même source, en l’absence de dispositions législatives conflictuelles, cette compétence revient exclusivement au ministre des Petites et Moyennes Entreprises. Cette décision vise à éviter les conflits d’attribution et à garantir une gouvernance réglementaire cohérente.

« Le Conseil d’Etat est d’avis que, sur l’impiètement des compétences, la sous-traitance dans les secteurs privés est une matière transversale. Elle concerne tous les secteurs d’activité, qu’il s’agisse notamment de mines, des hydrocarbures ou des ressources hydrauliques et électricité, d’eau, des bâtiments, de l’industrie, des forêts, pêche et élevage. Elle relève cependant, à l’absence d’une autre loi, de la compétence exclusive du ministre ayant les petites et moyennes entreprises, dont ses attributions, qui, par voie d’arrêté ministériel, est habilitée à prendre les mesures d’application de la loi », affirme cette juridiction.
 
En ce qui concerne la validité des deux arrêtés, le Conseil a souligné que l’un d’eux, bien que signé par le ministre des Hydrocarbures, enfreint les attributions du ministère des PME.

Abordant la question du retrait des autorisations accordées dans le cadre de la sous-traitance, le Conseil relève que seule l’ARSP est habilitée à annuler celles qui ne respectent pas les lois existantes.

Face à cette complexité, le Conseil d’État a recommandé à la Première ministre, cheffe du gouvernement de faire usage de ses prérogatives constitutionnelles pour résoudre ces conflits de compétences.

Selon la juridiction, cette action vise à garantir une régulation efficace des activités de sous-traitance dans le secteur privé en République Démocratique du Congo.

Il convient de rappeler que cette mesure découle du contrôle de conformité réalisé en novembre 2025. Elle s’inscrit dans la vision du Chef de l’État, Félix-Antoine Tshisekedi, visant à promouvoir l’accès des PME congolaises aux marchés de la sous-traitance, afin de favoriser l’émergence d’une véritable classe moyenne congolaise.
